Owning or controlling the foreign company does not automatically prevent a Spain Digital Nomad Visa application, but current UGE practice expects a stronger, case-specific evidence package showing genuine company activity, ownership, staff, tax and employment substance, and real third-party business.
01 / Overview
Owning the Company Is Not an Automatic Refusal
Owning or controlling the foreign company used for your Spain Digital Nomad Visa application does not automatically make the case ineligible.
But an owner-controlled application should not be treated like an ordinary external-client freelancer file. Current UGE practice expects a stronger, more case-specific evidence package showing that the company is genuinely active and that the professional relationship, business activity and corporate structure are real.
The key distinction
Possible does not mean simple
Ownership itself is not the problem. The challenge is proving that the company is a genuine operating business and that the DNV relationship is supported by consistent corporate, commercial, tax and employment evidence.
02 / Core requirements
The Normal DNV Rules Still Apply
An owner-controlled case still has to satisfy the underlying requirements of the international teleworker route. Company ownership does not replace any of them.
-
01
The applicant must qualify as a third-country national under the international teleworker framework.
-
02
The work must be genuinely and fully telematic. Every essential duty must be capable of being performed remotely through IT, telematic and telecommunications systems.
-
03
The foreign company or group must show at least one year of real and continuous activity.
-
04
The qualifying professional or commercial relationship must have existed for at least the three months immediately before filing.
-
05
The applicant must have a qualifying education credential or at least three years of relevant professional experience. When relying on experience, a contract alone should not be treated as complete proof.
03 / Owner-controlled cases
Why UGE Looks More Closely at Your Company
When the applicant owns or controls the company used for the professional relationship, current UGE practice expects stronger evidence of company substance.
The company needs to be demonstrably active rather than existing only on paper. Current practice also expects evidence that the company has employees other than the applicant, together with the relevant ownership, corporate, tax and Social Security or employment evidence.
Current UGE practice
The Company Should Not Consist Only of You
This is an important current-practice point, not wording taken directly from the statute. Spanevo’s current position is that an owner-controlled company should be able to show genuine operations, staff beyond the applicant and real third-party business or client activity.
A July 2026 UGE briefing reported by practitioners also highlighted the additional evidentiary, tax and relationship complexity of owner-controlled cases and the importance of genuine third-party business activity.
That should not be converted into a blanket rule that business owners cannot qualify. The correct conclusion is that these cases remain possible but require substantially stronger documentation.
04 / Evidence
What the Company Evidence Should Prove
The goal is not simply to produce more documents. The documents need to tell one consistent story about who owns the company, what the company actually does, who works there and how it conducts real business.
-
01
Ownership and control: evidence showing the corporate structure and the applicant’s ownership or control of the company.
-
02
Corporate existence and history: official company evidence supporting at least one year of real and continuous activity.
-
03
Employees and employment substance: current UGE practice expects evidence that the company has employees other than the applicant, supported by the appropriate employment and Social Security records.
-
04
Tax and corporate records: evidence that supports the company’s genuine operating activity and is consistent with the rest of the dossier.
-
05
Third-party business activity: evidence showing genuine business or client activity beyond the applicant’s own relationship with the company.
-
06
The qualifying relationship: evidence covering the required three-month professional or commercial relationship, together with the corresponding income and payment evidence required for the DNV application.
05 / Pre-filing evidence
Do Not Ignore Your Own Registration History
For professional or self-employed applicants, Spanevo currently applies a conservative pre-filing check based on recent UGE case practice: the applicant should be able to document the required self-employed registration in the relevant country of origin or provenance for the complete three months immediately before filing.
This point comes from current UGE case practice and should not be described as a standalone statutory rule. A previous client contract by itself may not cure a shorter period of official registration.
Before filing
Check the Dates, Not Just the Contract
Confirm that the official registration history, qualifying relationship, invoices or other income evidence and bank payments all cover the required pre-filing period consistently.
06 / Current scrutiny
What UGE Is Really Testing
An owner-controlled case creates an obvious evidentiary question: is there a genuine foreign business and professional relationship, or does the paperwork exist only because the applicant controls both sides of the structure?
The answer has to come from objective evidence. Company history, ownership records, employees, third-party activity, tax and employment records, the applicant’s professional relationship and the money trail should support each other.
That is why these applications are more documentation-heavy than a straightforward case involving an unrelated foreign client or employer.
07 / Practical next step
Build the Evidence Package Before You File
If you own or control the company supporting your DNV application, do not start with the assumption that ownership disqualifies you. Start by testing whether the company and relationship can be evidenced properly.
Confirm the one-year company history, three-month relationship, genuinely remote duties, qualification or experience route, ownership structure, employees, third-party activity, corporate records and the supporting tax, Social Security and payment evidence.
If those pieces do not align, it is better to identify the gap before translations, legalisations and filing costs begin.
